REACH regulation compliance checklist

The REACH Regulation is a European Union (EU) law that aims to improve the protection of human health and the environment by regulating the production and use of chemicals. To comply with the REACH Regulation, a brand should consider the following checklist:

  1. Identify the substances used in your products: Review your products and their ingredients, and identify any substances that are subject to the REACH Regulation. This may include substances on the EU's Candidate List of Substances of Very High Concern, as well as substances that are used in large quantities.

  2. Determine your obligations under REACH: Based on the substances used in your products, determine your obligations under the REACH Regulation. This may include registering the substances with the European Chemicals Agency (ECHA), providing information on their safe use, and managing their potential risks.

  3. Develop a REACH compliance plan: Develop a plan to ensure compliance with the REACH Regulation, including steps such as registering substances with the ECHA, providing safety information to customers and downstream users, and implementing risk management measures.

  4. Communicate with your supply chain: Engage with your suppliers and other members of your supply chain to ensure that they are also complying with the REACH Regulation and providing you with the necessary information and documentation.

  5. Monitor and update your compliance efforts: Regularly monitor and update your compliance efforts to ensure that they remain effective and in line with the latest developments under the REACH Regulation. This may include staying up-to-date on new regulations and guidance, as well as conducting periodic audits and assessments.

  6. Document and maintain records: Keep detailed records of your compliance efforts, including records of your substance registration, safety information, and risk management measures. This will help to demonstrate your compliance with the REACH Regulation if it is ever questioned.

  7. Engage with relevant authorities: Engage with relevant authorities, such as the ECHA and national enforcement agencies, to ensure that you are meeting your obligations under the REACH Regulation and to seek guidance and support as needed.
